When an
individual passes on, certain assets of the decedent
(non-probate) may be transferred by contract, such as
joint and survivorship property, payable on death
accounts, transfer on death property, and most life
insurance and retirement benefits.
Other
assets may be transferred through proceedings in Probate
Court. Whether if an individual passes away leaving
both probate and non-probate assets, generally some type
of documentation is required to complete the transfer.
There are advantages and disadvantages in using
non-probate or probate proceedings which
Michelle
R.
Donahue, PA,
will be happy to explain to you in detail, while
assisting you in determining the best manner in which to
hold your assets.
It is the
Probate Court's responsibility to ensure the probate
assets are collected, maintained, and distributed among
the decedent's heirs, beneficiaries, and/or creditors
according to the direction of the decedent as expressed
through a will and the laws of Florida, or the State
which maintains jurisdiction of the estate. This
process is known as the administration of a decedent's
estate.

During this
process, an estate administrator may be approved by the
court according to the wishes of the
decedent wishes, interested
parties may petition the court to be legally recognized
as the estate administrator, or the court may appoint an
individual to be temporarily or permanently assigned as
the estate administrator.
Typically an estate
administrator is a family member, a trusted family
friend or business partner, an attorney, or court
appoint estate professional.
While performing
the fiduciary duties of estate administration, the
administrator of the estate must follow very specific
guidelines, and always act in the best interest of the
beneficiaries of the estate. Failure to adhere to the
guidelines of their fiduciary duties may result in the
individual loosing their estate administration duties,
and severe infractions may even result in criminal
charges.
