When an individual passes on, certain assets of the decedent (non-probate) may be transferred by contract, such as joint and survivorship property, payable on death accounts, transfer on death property, and most life insurance and retirement benefits.

During this process, an estate administrator may be approved by the court according to the wishes of the decedent wishes, interested parties may petition the court to be legally recognized as the estate administrator, or the court may appoint an individual to be temporarily or permanently assigned as the estate administrator.

Typically an estate administrator is a family member, a trusted family friend or business partner, an attorney, or court appoint estate professional.
